What Does the Executive Order Actually Say and the Impact on Sanctuary Jurisdictions?

Edward “Ted” Waters, Esq., Managing Partner, Feldesman Tucker Leifer Fidell LLP

On January 25, 2017, President Trump signed an Executive Order (EO) that stated that the Policy of the United States will be to ensure that any state or locality designated by the Secretary of the Department of Homeland Security and the Attorney General as a “Sanctuary Jurisdiction” will not be “eligible” to receive federal grant funds. Sanctuary jurisdictions, according to the EO, are those states or localities that “willfully violate Federal law in an attempt to shield aliens from removal from the United States.” This session will not only address what the EO actually say and what is its short and long-term legal implications for both Sanctuary Jurisdictions and its constituents.

Learning Objectives

  • Understand what is contained in the EO;
  • Learn what impact the EO has on sanctuary jurisdictions and constituents;
  • Hear what legal limitations and roadblocks exist at the federal level.
